These Terms & Conditions (“Terms”) govern your access to and use of www.sagewoodskincare.com (the “Site”) and any purchase of our products (“Products”). 

By accessing the Site or purchasing from us, you agree to be bound by these Terms.

If you do not agree to these Terms, please do not use the Site or purchase our Products.

“Sagewood Skincare,” “we,” “us,” and “our” refer to Sagewood Collective LLC, a Texas-based company.

By using the Site, you represent that:

• You are at least 18, and
• You have legal capacity to enter into these Terms.

All Sagewood Skincare Products are intended solely as cosmetics—for cleansing, moisturizing, and enhancing the appearance of the skin.

• Our Products are not intended to diagnose, treat, cure, or prevent any disease or medical condition.
• Nothing on this Site, our packaging, emails, or social media should be taken as medical advice.
• If you have a skin condition, allergy, are pregnant, nursing, immunosuppressed, or under medical care, consult your licensed healthcare provider before using any new skincare product.

Use Products only as directed and discontinue use if irritation occurs.

When you place an order, you:

• Agree that all information you provide is accurate, complete, and current.
• Authorize us (and our payment processors) to charge your selected payment method for the total order amount, including applicable taxes, shipping, and fees.

We reserve the right to:

• Refuse, limit, or cancel any order at our discretion (including suspected fraud or misuse).
• Correct any errors in pricing or product information and cancel or update orders affected by such errors, with notice and refund where applicable. 

Your order is accepted once we confirm it and begin processing or shipping.

• All prices are listed in U.S. Dollars (USD) unless stated otherwise.
• Prices and availability are subject to change without notice.
• Applicable sales tax will be calculated and added at checkout based on your shipping address and current law.
• We do not guarantee that all Products displayed on the Site will be in stock at all times.

We ship to the locations listed at checkout.

• Shipping options, timelines, and costs are displayed during checkout.
• Any shipping timeframes are estimates, not guarantees.
• Risk of loss and title to Products pass to you upon delivery to the carrier.

If your order arrives damaged or appears lost, contact us promptly at hello@sagewoodskincare.com with your order details.

• Due to the nature of skincare, we can only accept returns of unopened, unused Products in original packaging within 30 days of delivery, with proof of purchase.
• We do not accept returns of used products based solely on personal scent/texture preference or results, unless required by law.
• To request a return or report an issue, contact us at hello@sagewoodskincare.com with your order number and details.

We reserve the right to deny refunds or replacements if return conditions are not met or abuse is suspected.

If you create an account on our Site, you are responsible for:

• Maintaining the confidentiality of your login credentials;
• Restricting access to your device; and
• All activities that occur under your account.

We may suspend or terminate accounts that violate these Terms or appear fraudulent.

All content on the Site—including text, product names, formulas (unless otherwise stated), graphics, logos, images, designs, and layouts—is owned by or licensed to Sagewood Skincare and protected by applicable intellectual property laws.

You may not:

• Copy, reproduce, distribute, modify, or create derivative works from our content;
• Use our trademarks, trade dress, or logos without our prior written permission.

Personal, non-commercial browsing and purchasing is allowed; anything beyond that, ask first.

You agree not to use the Site or Services to:

• Violate any applicable law or regulation
• Infringe on any intellectual property or privacy rights
• Transmit harmful code, spam, or fraudulent content
• Scrape, harvest, or misuse data from the Site
• Interfere with security or normal operations of the Site

We may restrict or terminate access if we believe there is abuse or unlawful behavior.

Our Site may contain links or integrations with third-party websites, tools, payment processors, or social platforms.

• We are not responsible for the content, policies, or actions of third parties.
• Your use of third-party services is governed by their terms and privacy policies, not ours.

To the fullest extent permitted by law:

• We do not guarantee that the Site will be uninterrupted, error-free, or secure.
• We do not guarantee specific results from use of any Product, as skin types and conditions vary.

Any product descriptions, testimonials, or before/after language are illustrative only and not a promise of identical results.

To the fullest extent permitted by law:

• Sagewood Skincare, [Sagewood Collective LLC], its owners, officers, employees, and affiliates will not be liable for any indirect, incidental, consequential, special, or punitive damages arising out of or related to:
  
  • Your use of or inability to use the Site or Products;
  • Any content or conduct of any third party;
  • Any unauthorized access to or use of our systems.

Our total liability for any claim related to your use of the Site or Products will not exceed the amount you paid for the specific Product(s) at issue.

Some jurisdictions do not allow certain limitations; in those cases, some of the above may not apply to you.

You agree to indemnify, defend, and hold harmless Sagewood Skincare, [Sagewood Collective LLC], and our affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to:

• Your use of the Site or Products,
• Your violation of these Terms, or
• Your violation of any law or third-party rights.

These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-law principles.

Any dispute arising out of or relating to these Terms or your use of the Site or Products shall be resolved in the state or federal courts located in Denton County, Texas, and you consent to the exclusive jurisdiction of those courts.

We may update these Terms from time to time.

• When we do, we will revise the “Effective Date” above.
• Material changes may also be communicated via the Site or email.

Your continued use of the Site or purchase of Products after any update constitutes acceptance of the revised Terms.
